## Clarity Act fails Senate cloture vote

The U.S. Senate on Tuesday blocked the Digital Asset Market Clarity Act, known as the Clarity Act, from advancing, dealing a major setback to the crypto industry's push for a comprehensive market structure framework. The procedural motion to proceed drew 49 votes in favor and 50 against, well short of the 60 needed to clear the filibuster, with no Democrats voting yes.

The bill would have split oversight of digital assets between the SEC and the CFTC, set registration requirements and strengthened anti-money laundering protections. For months, negotiations stalled over ethics provisions covering public officials' crypto profits, including those of President Trump and his family, who disclosed ＄1.4 billion of crypto-related income last year.

Senator Thom Tillis, one of four Republicans who voted no, filed a motion to reconsider, leaving the bill technically alive. But with the House recessing and the Senate expected to leave in early October ahead of the November midterms, a second vote looks unlikely this year. Bitcoin fell about 3%, while Coinbase and Circle shares dropped 8% and 10%. The industry now looks to SEC and CFTC rulemaking for near-term clarity.

## CoinEx to shut down exchange operations after 9 years

CoinEx has announced that it will cease operations and begin an orderly shutdown, citing a prolonged crypto market downturn, a sharp contraction in industry-wide trading volume and liquidity, and rising regulatory requirements and compliance costs. The exchange, which launched on December 22, 2017, has been running for nearly nine years.

Under the timeline, CoinEx will stop new user registrations and switch futures trading to reduce-only mode on September 15\. All non-spot services, including futures, earn, staking and lending, will end on September 22, followed by a halt to all spot trading on September 29\. Withdrawals will remain open until December 22, when the platform officially closes. CoinEx said its asset reserve ratio exceeds 100 percent and that all user assets are fully backed.

Founder Yang Haipo said CoinEx failed to become one of the industry leading exchanges, and that the security and compliance risks of running a crypto exchange have become increasingly difficult to control — assuming unlimited risk in exchange for limited revenue is no longer a rational choice. The exchange will repurchase its CET token at the initial listing price of 0.005 USDT, and said the shutdown will not affect ViaBTC operations.

## SEC issues "Innovation Exemption" to facilitate trading of tokenized NMS stock

The Securities and Exchange Commission on September 17 issued an order granting temporary, conditional exemptive relief to Tokenized Securities Venues, or TSVs, from the definition of "exchange" under the Securities Exchange Act of 1934, allowing them to trade tokenized National Market System (NMS) stock through permissioned automated market makers and liquidity pools. Chairman Paul S. Atkins called it a significant step to bring America's capital markets into the digital age, while stressing the relief is temporary and open for public comment. Jamie Selway, Director of the SEC's Division of Trading and Markets, said the division stands ready to work with parties seeking to operate a TSV.

The exemption carries conditions: tokenized NMS stocks face limits on the number of symbols and volume traded; a TSV must verify holders receive the same rights and privileges as traditional NMS stock of an equivalent class; it must give written notice and an opportunity to object to the underlying issuer before listing shares tokenized by an unaffiliated third party; smart contracts must be auditable, public, and deployed on a public permissionless ledger; trading must stop concurrently with any halt on the primary listing exchange; and a TSV must publicly disclose its operations and affiliate trading. The order also grants liquidity providers using proprietary capital a conditional exemption from the "dealer" definition. The exemptions expire five years after publication.
